What Is Mediation and Arbitration?
Mediation is an ADR process where a third-party neutral (mediator) facilities communication between disputing parties in order to reach a successful resolution. Many times, courts will require mediation before litigation can even begin. If a solution is reached, the agreement is binding. Parties can still have the option of moving on towards litigation. However, details of a mediation conference are always confidential and cannot be used in court.
